We-Vibe Privacy Violation Canadian Class Action

Statement of Claim
CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against Standard Innovation Corporation on behalf of all consumers who purchased a Bluetooth-enabled We-Vibe vibrator (We-Vibe Classic, We-Vibe 4 Plus, We-Vibe 4 Plus App Only, Rave by We-Vibe, and Nova by We-Vibe) [the “We-Vibe Products”] and/or downloaded the We-Connect Application [the “We-Connect App”] and used it to control a We-Vibe Product.
Standard Innovation Corporation is a “sensual lifestyle products” company that markets, sells, and supports a line of high-end vibrators under the We-Vibe product label. The defining feature of the We-Vibe Products is their ability to be remotely controlled through the We-Connect App, which users download from the Apple Store or the Google Play Store and install onto their Smart Devices. By downloading the We-Connect App, users can “pair” their Smart Devices to the We-Vibe Products using a Bluetooth connection, allowing both themselves and their partners remote control over the vibrator’s settings and features.
Without notifying or warning its consumers, Standard Innovation designed the We-Connect App to: (i) intercept, monitor, collect, record, utilize, transmit, and/or store highly intimate and sensitive data regarding consumers’ personal We-Vibe Product use, including the date and time of each usage, the chosen vibration settings, the vibration mode or pattern selected, the We-Vibe Product’s temperature and battery life and to (ii) transmit and store such usage data – along with the user’s personal email address – to its servers.
In order to induce purchase and use, Standard Innovation failed to disclose the reality of its invasive information collection practices to its customers.
