CONSUMER LAW GROUP has launched a Canada-wide class action lawsuit against 3M and Arizant Healthcare with respect to orthopedic surgical patients who developed serious infections following hip or knee replacement surgery with the use of the Bair Hugger Forced Air Warming device (“Bair Hugger FAW”).

The Bair Hugger FAW consists of a portable heater/blower connected by a flexible hose to a disposable blanket that is positioned over (or under) surgical patients. The system warms patients during surgery by blowing hot air on a patients’ exposed skin. The Bair Hugger FAW device blankets and gowns were used in over 22 million surgeries last year alone.

The Canadian class action lawsuit is based on claims that the hot air produced by the Bair Hugger FAW device picks up germs and bacteria from the floor of the surgical room and deposits it into the surgical site and onto the hip or knee replacement device being implanted. As a result, joint replacement patients are at risk of developing dangerous complications, including Methicillin-resistant Staphylococcus Aureus (MRSA), sepsis and deep joint infections, thereby requiring several reparative surgeries.

The types of injuries that orthopedic implant surgery patients who develop infections as a result of the Bair Hugger FAW may include:

• Multiple hospitalizations
• Additional surgeries
• Insertion of antibiotic spacers in the infected joint
• IV antibiotic therapy
• Physical therapy
• Removal and revision of the implant device
• Amputation
