CONSUMER LAW GROUP has filed a class action lawsuit against FCA (Fiat Chrysler Automobiles) and Cummins relating to high levels of emissions in certain Dodge Ram trucks equipped with a Cummins 6.7-litre diesel engine.
The vehicles involved are:
-Dodge RAM 2500 with a Cummins diesel (SCR systems, 2WD, 4WD) (model years 2013, 2014, 2015, 2016, & 2017)
-Dodge RAM 3500 with a Cummins diesel (SCR systems, 2WD, 4WD) (model years 2013, 2014, 2015, 2016, & 2017)
The class action alleges that the automaker and the engine manufacturer knowingly sold thousands of trucks equipped with Cummins diesel engines that release up to 14 times the legal limit of nitrogen oxides (NOx). These trucks also have a selective catalytic converter (SCR) system that breaks down and a diesel particulate filter (DPF) that becomes clogged with soot. When the DPF becomes clogged, fuel consumption is increased.
To appeal to eco-friendly consumers, FCA and Cummins continuously marketed the trucks’ engines as meeting “all EPA Heavy Duty Diesel Engine Emission Standards, resulting in one of the lowest emitting diesel engines ever produced.” It is alleged that these representations are deceptive and false.
Consumers have suffered damages as a result of their purchases of these vehicles, including but not limited to: (a) a high premium for the diesel engine compared to what they would have paid for a gas-powered engine, (b) out-of-pocket losses and future attempted repairs, (c) future additional fuel costs, (d) decreased performance of the vehicles, and (e) diminished value of the vehicles.
